I take my constitutional duty in the judicial confirmation process very seriously. I have worked hard to help confirm 205 of President Bush's judicial nominees. In my role as a member of the Senate Judiciary Committee, I've been able to ensure confirmation of all of President Bush's federal judicial nominees from Ohio, including five federal District Judges and two federal Court of Appeals Judges. Currently, there are two upcoming vacancies in Ohio. U.S. District Court Judge Walter Rice from the Southern District of Ohio and U.S. District Court Judge David Katz from the Northern District of Ohio recently decided to assume senior status. I will work hard to ensure that the best possible candidates are nominated to fill those vacancies. Regrettably, but understandably, Miguel Estrada withdrew his nomination, and Charles Pickering and Claude Allen declined to be re-nominated by the President this year. ACLU Appeals Decision To Block A 13 yr Old Girls Abortion

Florida State Department of Children and Families petitioned Palm Beach County Juvenile Court Judge to issue an injunction to block a 13 year old girl who is 13 1/2 weeks pregnant from getting an abortion. The judge issued the temporary injunction and issued an order for a psychological examination. The ACLU filed an appeal to get the order reversed citing, "the ruling that would essentially force the girl to become a mother" according to executive director Howard Simon. The teen, identified as L.G., has been described as a long time ward of the state, found out that she was pregnant 2 weeks ago. And was planning to undergo the abortion on Tuesday. Her caseworker even arranged transportation for the girl. But the state Department of Children & Families asked a Palm Beach County juvenile judge Tuesday morning to block the abortion. The agency argued that L.G., who is 13½ weeks pregnant, was too young and immature to make an informed medical decision, according to the appeal filed by the American Civil Liberties Union. The appeal claims that Florida law protects her right to make this decision. In 2003, the Florida Supreme court struck down a law requiring that parents of a teenager to give consent before performing an abortion. "DCF and the circuit court have instituted a process whereby the state will make a decision for L.G. based upon its own evaluation of her best interest. This it cannot do,'' the appeal said. On the flip-side of the coin is DCF which claims that Florida law prohibits DCF from consenting to an abortion in any instance. "If a child in our care requests to have any procedure prohibited under Florida statute, we cannot give consent,'' Munoz said. "It's not our decision. We stand in different shoes. We're held to a higher accountability.'' "No DCF regulation or state law can override a constitutional right as recognized by the U.S. Supreme Court,'' Simon said. "But putting aside the legalisms, forcing a 13-year-old to carry an unwanted pregnancy to term against her wishes not only is illegal and unconstitutional, it's cruel.'' The appeal stated, "There is nothing in the record to support the presumption that she cannot make an informed decision to have an abortion.'' Rep. Jeffrey Kottkamp (R-Cape Coral) stated, "If she's not old enough yet to decide if she should have a tattoo, or drive, or vote, how in the world is she old enough to make such an important decision on her own? But was countered by Rep. Ann Gannon (D-Delray Beach) who said, "I think this is merely the governor playing politics once again." She goes on to say, "I think that a 13-year-old who is mature enough to make the decision to have sex is mature enough to decide whether to terminate a pregnancy,'' she added. "The reality is, I don't want 13-year-olds having sex. But I want them to have access to accurate information and education.'' (source) Here's the facts folks. She's a ward of the State of Florida, therefore she's in the custody of DCF. Now, regardless if Florida law doesn't require a parent to give consent, DCF has a regulation that doesn't allow them, as a department of the state, to give consent to an abortion. She got herself into this trouble because she has displayed an inability to make informed decisions on her own. And now she is trying to get out of the consequences of the decision that she made by using abortion as a form of birth control. This is exactly why teenagers who want an abortion to get parental consent. Because they cannot make decisions on their own. The ACLU in their quest to kill off babies, the elderly, and the disabled, are blinded to the fact that she has already displayed an inability to make an informed decision. She had sex by choice. She got pregnant as a result of that choice. And because she is a ward of the state, the state makes the decisions for her. In my opinion, DCF has made the right decision. This baby should be carried to term, then put up for adoption. Children who decide to make decisions that they are unprepared to make, must learn that they have to live with those decisions. By allowing this girl to murder this baby because she made an bad decision, she will learn nothing from it.

Clouded Judgment, Socialist Indoctrination, And The Truth

Many on the left do not realize what they are supporting. I know, I used to be a Dumocrat. I will tell you when I came to my senses, March 1993. Why do I remember this, it's when the alleged "New Democrat" Bill Clinton started to show his ultra liberal colors. In the May primary, I switched parties. I was 23 years old. When you are in school, you get all kinds of leftist stimuli. The schools system where I attended would promote their operating levies by telling us that one program or another was going to be cut should voters not pass the levy. I have since learned that every election cycle, this same school system has a renewal levy. These are levies which were passed to build new buildings and improve grounds. But, those have been paid for. This school system has the highest paid teachers in the county where I live. Why? Because each time a levy passes, it covers pay increases for teachers. Teachers that I don't really believe that I learned much from.

These 5 quotes factor rather profoundly in the politics of education. There is an old saying, Those who can - do, those who can't - teach. And this is a undisputed truth. Think of it. If an economics professor was any good at being an economist, don't you think that he'd be making more money as a consultant to governments and private business? These people make a decision when they are in college, to go into education because they don't have the guts to face the harsh competitive world of business. They make decisions about their own political and economic philosophies that cannot compete in the business world. These people are liberal. These people have studied economics and gotten seduced by the dark side. Marxism. And that has spread like a plague throughout the educational system. From the economics professors to high school and elementary school teachers. The very people that Hitler, Stalin, Marx, and Lenin talked about in the quotes that I cited. Our public school systems, universities, and colleges have been the indoctrination centers for the youth. People like Ward Churchill are teaching our young. And that's scary. I am heavily involved in the Stop The ACLU movement that has gotten started. And I am proud to be associated with the other bloggers who are spear-heading this movement. We are the ammunition that will hopefully get some of the damage caused by the liberal movement reversed. We are the majority in America. We are the majority in the Congress. And our President is a Conservative. And it's time we build and expand our political power. And how do we do that? By telling the truth. We don't need to whitewash anything. We tell the truth. Which ones have had a track record of deception? I can think of Nazi Germany, The Soviet Union, China, Cuba, Fascist Italy, Baathist Iraq, Iran, Afghanistan under the Taliban, and several Socialist Asian and African countries. Now who in the United States has a track record of deception? The ACLU doesn't share it's funding sources. They refuse to publish their policy guide. And they will back a position for a certain segment of the population and oppose it for another. The Dumocratic Party has been deceptive. Just think about the recent debates happening on party lines. House ethics questions, Social Security reform, ANWR, and the list goes on and on. And the biggest deceptionist of all, Slick Willy.

Tax Reform & Why It Will Probably Never Happen

Now... Now, before you go off and think that I've lost my mind, hear me out. I took a long walk today, something that northern Ohioans don't get much of a chance to do during the winter. And while I was letting my mind clear, I came to a conclusion about why we could never have tax reform. The fair tax is just that... it's fair. And the left could never allow that to happen. Their power base is the poor. And as long as they can point to the wealthiest Americans and blame them for the plight of the poor, they will keep that power base. But what if that power base disappeared? The fair tax is a plan that if enacted, would lead to prosperity at a level that this country hasn't seen since the post World War II era. And the lefties can't have that. If this country would stage that kind of economic come back using capitalist policies, there would be no use for the big government that they are envisioning. So as long as there are radical Social- ah liberals in the Congress, we will never have the 2/3 majority needed to repeal the 16th Amendment and establish the fair tax. And that is the reason why I say that it will never happen. And without meaninful tax reform, anything that the government comes up with to fix Social Security will at best be only a short term fix. It would be like putting a band-aid on a leak in Hoover Dam. But, there is a way to get around these ratical Social- ah... liberals in the Congress (Kennedy, Kerry, Clinton, Byrd, etc.). Get the word of the fair tax out to the people. Demonstrate to the people that there is no down side to this plan. Demonstrate that the prosperity of the 1950's could return. So my fellow Conservatives... Shout it out! Get the word out that the fair tax is the only solution to regaining economic freedom. We are batting 1.000 when we work together. Rather is gone, Jordan is gone, and we recently shut down a terrorist blog. We can do this and prove my heading wrong.

Stop The ACLU BlogBurst 4/28/05

The American Civil Liberties Union. Let's break down the name of that organization. The American, hmmm that seems like they should be looking out for Americans doesn't it. Civil Liberties Union, well, that I take to mean that it's an organization that seeks to guard the civil liberties of Americans. Then why is it that the ACLU is suing the Secretary of Defense for alleged abuses against foreign nationals on foreign soil? Uh.....I can't figure it out. The Secretary of Defense if I remember correctly, is an American. The laws of the United States that protect the civil rights of Americans do apply to any foreign nationals who happen to be in the United States. But not in Iraq. Not in Afghanistan. And not in Cuba. When an American citizen joins the military services, he/she surrenders his/her civil rights for the benefit of the people of the United States. It's part of the sacrifice that we ask them to make. So, one can say that the civil rights of American citizens on a military base, located on foreign soil, are sacrificed as well. The Uniform Code of Military Justice is the governing authority on military installations. That being said, the prisoners at Guantanamo Bay are not on United States soil. And, because they were not uniformed combatants on the battlefield, but took up arms against our troops, they are therefore considered spys or terrorists and not subject to the provisions of the Geneva Conventions. The Conventions dictate to us as a signatory that we must provide the protections to our enemies regardless if they are party to the Conventions themselves. But these Conventions were agreed upon without an understanding of the type of warfare being waged against us. Our enemies brought this war to us. They declared it. We didn't . We were content to stay out of the terrorism game all together. But since we have been dragged into this fight kicking and screaming, we should be determined to win it. That means stepping on a few toes might and have happened. The ACLU should be more concerned about protecting our own citizens than foreign terrorists who have been killing our troops. Why didn't the ACLU come to the aid of Raven Furbert when her civil rights were violated? That was a clear violation of her rights. Why? Because they don't have our best interests in mind. They are a left wing, liberal, radical organization who is out to put people like them into positions that will create a situation in this country reminiscent of Orwell's 1984. Keep in mind, Liberals=Big Government. Big Government=oppression. The very thing that they are supposed to guarding us against. I wish they would figure out who they are trying to protect.

Border Patrol Has Issues with ACLU Operatives in Monitored Sector

(AgapePress) - The union representing Border Patrol agents in the Tucson sector says its members have had no complaints about the volunteers taking part in the Minuteman Project, which is wrapping up this week in the Arizona desert. But apparently the Border Patrol has had some problems with the ACLU.

Since the first of April, volunteers with the Minuteman Project have been conducting what it refers to as a "citizens' Neighborhood Watch" along the Arizona-Mexico border, looking for illegal immigrants crossing over into the U.S. and reporting those sightings to the Border Patrol. The group reports that as of April 24, 315 Border Patrol apprehensions have been "directly facilitated" by Minuteman volunteers.

Mike Albon is a spokesman for U.S. Border Patrol Local 2544, which represents the agents patrolling the 27-mile sector where the Minuteman volunteers have camped out this month. Albon says there have been no complaints from his rank-and-file about the volunteers' work.

"The Minutemen have not caused any problems for the agents in the field," Albon states. "We have not received any complaints [about] any of their activities being out of line. They have been real supportive of the [Border Patrol] agents in the field."

But the union spokesman says activities in the area by American Civil Liberties Union representatives have been counterproductive. "Apparently trying to catch the Minutemen doing something wrong, [someone] has been going out there and setting off [ground] sensors," he explains. Those actions, he says, have caused extra work for Border Patrol agents in the field. "They're counterproductive in [doing] things like that," he says.

Albon says his union is against any organization that opposes enforcement of American immigration laws. "We are against anything that is anti-enforcement," he remarks. "The union wants the immigration laws enforced -- and if the ACLU is supporting things that are not related to the enforcement of the law and are supporting people who are breaking the law, we do not condone that."

WorldNetDaily reported in March that the Arizona chapter of the ACLU planned to monitor the activities of the Minuteman Project volunteers to "make sure they're not abusing anybody's rights." A spokesman for the ACLU told a local newspaper that a team of attorneys would be ready to file civil cases against project participants should any abuses occur.

Education And The No Child Left Behind Act

With up-most respect for our President, I don't believe that the No Child Left Behind Act goes far enough. I believe that the only way to insure that every child receives a quality education can only come from a complete overhaul of the system. First off what has to go is the National Education Association. NEA has snowed every local school district into this idea of tenure. And if you read my blog, you know what tenure is. It's permission to become incompetent. We shouldn't be rewarding teachers who don't perform just because they have longevity. Do you think that General Motors will reward an employee who shows up everyday and makes a superficial effort at doing his/her job? Do you think that if the employee was a welder, he/she could get away with only making enough welds to hold the car together long enough to make it through the line? I guarantee that doesn't happen. I can say this with authority. I've worked for a company who supplies GM with parts for their cars. There is a stringent standard that each part must pass. The whole system is designed to make sure that the defect rate on parts that make it through to a finished car is less than 1%. And yet we allow a system to go on that has a success rate of less than 75%. So I say it's time to break the Union. The NEA is the major contributor to the problem and counting on their help for a solution is wishful thinking. Our children cannot compete with other children in the world in math and science. Why? Because our teachers make a superficial effort at doing their jobs. Any moron who has a masters degree can teach. That is where the old saying "Those who can do, those who can't teach" comes from. We need people who care about their jobs. And how do we keep them caring? Make salaries outcome based. If your students fall short, so will your paycheck. I've gone into detail on how to make this happen, now we need to do it. Year after year our students fall further and further behind. Asians have our children beat in every academic category. Why? They care. Their teachers care, their parents care, and they care. Some of the best doctors in this country are of Asian decent. Why? Because they care stupid!! I will say this over and over again until I'm blue in the face. The only way we can make our teachers care is to base their incomes on performance. The only way to get our children to care is to be involved. Know what they are studying. And if you feel that you don't know enough about the subject, study with them. It's never too late to learn, for you or your children.

Math or Political Correctness ?

In keeping with my theme, FoxNews gave me fuel for my educational system fire. It seems in the predominantly well-to-do and liberal community of Newton, Mass, that the public school system is more concerned about teaching political correctness than math. " According to benchmarks for middle school education, the top objective for the district's math teachers is to teach "respect for human differences." The objective is for students to "live out the system-wide core value of 'respect for human differences' by demonstrating anti-racist/anti-bias behaviors."" "Priority No. 2 is where the basics come in, which is "problem solving and representation -- students will build new mathematical knowledge as they use a variety of techniques to investigate and represent solutions to problems.""Excuse me? In a Math Class, the teaching of Math is "Priority No. 2"?!? If this isn't a prime example of the liberal bias and forced instruction of our children, I don't know what is. These people ought to be hung for doing this crap. What ever happened to "Reading, wRighting, and aRithmetic"? This is an outrage. This has to stop. People it's time that we wake up and smell the skunk, because that's what this is. There was a big hoopla in the 1950's and 60's about Communist Influence in the Motion Picture Industry. The House Un-American Activities Committee if memory serves me correctly. Well, it's been proven that Hollywood has a leftist slant. Michael Moore put to bed any lingering doubts about that. I've been saying the teachers are worse than Hollywood. Why? Most kids can put 2 and 2 together and know that TV and Movies are not real. But teachers? They're real, aren't they? I mean you can touch them. So they must be real, right? So who is more believable? We have to stop this. The system is out of hand and needs not only reform, but a complete overhaul.Now my opposition to this doesn't mean that I believe the evils of racism shouldn't be taught. On the contrary. Way back when I was a little one in elementary school, they changed History to Social Studies. Hmm, racism and it's evils are a social problem. So why not teach it there. Devote several weeks in the curriculum to the subject of civil rights, racism, integration, and the whole lot. I mean it, knock yourself out. Schedule it in a class, but don't forget the History part. BUT DON'T LET THE SUBJECT OF THE CLASS SUFFER SO YOU CAN TEACH SOME TOUCHY FEELY LET'S ALL GET ALONG CRAP. Where are your priorities teaching that? GROW UP! TEACH DON'T PREACH! You are all so scared that Christian, Jewish, or other religious teachings will creep their way into the class room. For love of Mike, you took Christmas out of Christmas. I'm all for celebrating our entire heritage. Do something for all of them. But don't leave them out. Christmas is a Federal Holiday. And do you know how I know that? Banks, the United States Postal Service, and SCHOOLS ARE CLOSED. So, treat your politics like Christmas. Leave it out. That means no threatening our kids with all kinds of bad things if a levy doesn't pass. Keep in mind the Constitution establishes the voting age at 18 not 8. Most of the levies out now are renewals of emergency levies passed 25 years ago to build a new school or something. They were designed to expire for a reason. So, how many times must the public pay for the same building to be built? And just to remind you, Communism is just left of Liberalism on the political chart.

The Youth Are Smarter Than We Think

Those of us involved in the Stop The ACLU BlogBurst recently came across a young lady who surprised us with her knowledge. We assumed that she was in her twenties, but it turns out that she's a teenager. Well today, I came across a young man who is rather young himself. As a matter of fact he's a year younger than the teenage dynamo that we met several weeks ago. He is the editor-in-chief of a web-newsletter called Republican Voices. This newsletter has several contributing writers, a few of which are school age. Their identities are close guarded secrets because they fear retribution from the liberal public schools where they attend. The newsletter is dedicated to shining the light of truth upon the liberal public schools and their indoctrination techniques. I would eagerly encourage anyone reading this to check out Republican Voices. It is a well designed website with incredible articles.

The following information was gathered from snopes.com which was skeptical of the data. But, should we expect anything less out of researchers at a University? We all are aware of the liberal bias involved in the teaching profession. And the history of Universities being breeding grounds of liberal thought. So you can believe or not believe the data. Never-the-less it has circulated around the web. This data has been attributed to Professor Joseph Olson, who has denied being it's author. It is an analysis of the 2000 Presidential Election.

This information was obviously compiled prior to the settlement of the Florida re-count. Or as those of us on the right call it, the tremendous waste of time and taxpayer money. The murder rate information is questioned by one of those who were asked to review the findings. And that analysis has the rate in Gore counties at 6.5 to Bush counties at 4.1. That is still a significant number of murders in Gore country. (source) But what are we to gather from this information? If you look at the amount of square miles won by Gore and realize how close the vote was, you can see how unbalanced the country is. It is obvious that those who live in the population centers are overwhelmingly liberal. Those of us who live outside of the city centers tend to be more conservative. Traditionally, suburban and rural America have been strongholds of family values and religious conviction. Those of us who live outside of the degenerated population centers have no desire to be ruled by the will of those within those population centers. But we must watch, apathy on our part and we will be standing in hour long lines for a loaf of bread and told where we will live and what our job will be. Let those who live in those population centers be apathetic it could only serve to help us. Socialism has never worked in any country that it has been tried in. The early American settlers tried communal living and almost starved to death. When you remove the incentive of the reward gained by hard work, you remove the incentive to work hard. When everyone gains the same reward no matter how hard they work, no one will work hard. Why should they? Look at the teaching profession. Perfect example. The only American industry where a quality product is not required to be produced to get paid. The American worker is the hardest working in the world. Products made by our workers are the best in quality. But that quality comes at a price. Quality demands payment. Mediocrity is happy with whatever it gets. The harder you work and the better the quality of your work, the more you should be paid for it. That is the heart of Capitalism. Lefties call it greed. I call it compensation. Tax & Social Security Reform

Since the State of the Union, Social Security Reform has been at the forefront of public debate. The President wants a fix that provides personal accounts for younger workers to keep part of their own money from the pay as you go system and invest it. He also want benefits and tax rates to remain unchanged. But how to do it. How can you take money out of the system for the personal accounts and keep tax rates and benefits the same? It is no mystery, the system needs more money but where does it come from? The answer is tax reform. In order for us to have reform in Social Security, the tax system needs to be reformed first. There is a plan that would eliminate the tax on income and create a tax on what we spend. It's called the "Fair Tax". The plan calls for 2 Constitutional Amendments to be adopted. The first, to repeal the 16th Amendment to eliminate and forever outlaw taxes on income. The second, would establish the consumption tax. This tax would be paid only on new end user consumer goods. By eliminating the taxes on incomes, it also removes many hidden taxes that the consumer pays and never sees. Hidden in the price that you pay for a widget, is the cost of material used to produce it, the cost of the process used to produces it, the labor cost that it took to produce it, and employment costs the employer paid on the labor. And that is all factored in before the manufacturer's profit, the wholesalers costs and profit, warehousing costs, the retailers costs and profit all of which have employees involved and employment taxes that have to be paid on those employees. The "Fair Tax" eliminates all those hidden taxes and thus, lowering costs. Lower production and retail costs means lower prices to consumers. Lower costs and the elimination of taxation means more capital available to develop new products. New products mean expansion. Expansion means more jobs. More people working means fewer people on the taxpayer's dime. Which in turn saves the government money. More people working also means more people spending. More people spending means more revenue for the government. Money that could be used to shore up the failing Social Security program and give everyone what they want. The details of this plan are extensive and I'm just totally unqualified to relate them. However, the plan is laid out by Americans For Fair Taxation. Their website spells out the particulars to the plan. If I read the information correctly, it will be employers shopping for employees instead of the other way around. To not have a job will be intentional. Jobs that have left our borders would return. Because doing business in the United States would be cheaper. The ACLU's support of a legal precedent used to gain recognition of a student homosexual group has reversed now that the ruling is being used to back the rights of a Christian club on campus, claims a public-interest law firm.

The Associated Student Body at Kentridge High School in Kent, Wash., has rejected the Truth Bible Club because it required all members to adhere to a code of Christian conduct and voting members to sign a statement of faith. Also, the name of the club was deemed "offensive" and "proselytizes."

The case is governed by the Equal Access Act, a federal statute that requires schools to treat student clubs equally, notes the Arizona-based Alliance Defense Fund, which is defending the Truth Bible Club.

In Prince v. Jacoby, ADF argues, the Ninth Circuit held that denying official sponsorship of a club violates the Equal Access Act.

ADF points out that in 2003, shortly after Prince v. Jacoby was decided, the ACLU sent an information letter to school officials in Washington state explaining the case "makes it clear that student clubs promoting tolerance for gay students are entitled to the same resources as other clubs."

But now, the ACLU has filed a friend-of-the-court brief in the Truth case that takes the opposite position.

The ACLU now wants to strike down the Prince case if it will be used to allow a Bible club on campus, the ADF's Tim Chandler told WorldNetDaily.

"This goes to show how far the ACLU will manipulate the legal system to further their radical agenda," said Chandler, a litigation specialist who is working on the case.

"They are backtracking," Chandler said. "They used these laws to get what they wanted – equal rights for the gay-straight alliance – and now that they've gotten that, they want to retriact it so the Bible club doesn't get the same benefits."

An ACLU of Washington lawyer did not respond to WND for comment by press time.

The ACLU argues that the Equal Access Act only requires schools to allow clubs to meet on campus but does not require them to have equal access to all other benefits, such as funding and yearbook recognition.

The ACLU insists Prince should be overruled to avoid giving Truth any benefits beyond the right to meet on campus.

ADF spokesman Greg Scott said Truth applied for ASB status three times and was rejected each time. After numerous requests and demand letters to the principal and district counsel went without response, ADF filed suit.

ASB status is required to receive funding from the school, recognition in the yearbook, and access to the public address system and other forms of on-campus advertising. Non-ASB groups are permitted to meet on campus during non-instructional time, but cannot receive any other benefits.

Scott notes that in the Prince case, the successful petitioners were part of a religious club seeking Equal Access.

"The ACLU is obviously engaged in religious bigotry – in cases concerning homosexual groups, they argue that Prince fully applies, but now, when it clearly applies, using the ACLU's own standard, to a religious club, they are seeking to overturn the Prince decision," he said.

Dems Playing Politics As Usual

Dumocrats are trying to play hard ball in relation to the Tom Delay allegations. Yesterday, House Ethics Committee Chairman Doc Hastings offered to open a sub-committee investigation into the allegations. House Minority Leader Nancy Pelosi stated, "What Mr. Hastings was presenting was a sham. There is no Ethics Committee functioning right now, in terms of reviewing complaints for members." The reason why there is no ethics committee functioning right now, is because Dumocrats are boycotting the committee. Chairman Hastings made the offer in hopes to entice the Dumocrats in returning. But they apparently can't accept a win as a win. Especially since they have been calling for an investigation. (source) Since the beginning of this Congress, the press has been bombarded with these allegations against Rep. DeLay. And from the information in the press as of late, both Rep. Pelosi and Ethics Committee member, Rep. Stephanie Tubbs-Jones (D-Ohio), are also subjects of alleged wrong doing in connection with a trip they both took to the Caribbean. Seems to be a little hypocritical of Pelosi and Tubbs-Jones, as-well-as other members of the House who have engaged in similar activities. Especially since the alleged illicit activities by DeLay are practices of which several other members have engaged in themselves. And are traditionally accepted as "questionable" but legal. (source) The answer to the Dumocrats inability to accept an olive branch from the Chairman and Committee Republicans is simple. Take away the allegations against DeLay, and their political leverage goes bye-bye. It takes away some of the smoke and mirrors tactics that the Dumocrats employ to divert the attention of the American people, from the real issues which they are unable or unwilling to face. Social Security is a real problem. And the President put forth a proposal to open dialog on the issue. And instead of opening dialog the Dumocrats went on record to attack the proposal. Instead of putting forth a plan from the left side of the aisle, they divert attention. This is going to be their tactic until they either gain a majority control in the Congress or regain the White House. Bottom Line: Dumocrats need a whipping boy and they've picked Tom DeLay. And because he came out in defense of Terri Shiavo and has voiced his concern about activist judges, the Dumocrats are going to continue to whip away. They have an out but they are showing the country that they are unwilling to take it. Instead they are happy to play partisan politics to bring down the Republican Party. Because their goal is simple. They want a Socialist Society like Europe. Solution: Bloggers took down Dan Rather and Eason Jordan. We can end this petty partisan BS. Congress needs to start working on the nation's problems. And Dumocrats need to admit when they have been defeated. But they aren't going to do it on their own. We need to give them a little nudge. Adding or Repealing Constitutional Amendments

The ultimate authority in this country is the Constitution. In order to change this document, the Congress must follow a specific set of procedures. These are outlined in Article V. "The Congress, whenever two thirds of both Houses shall deem it necessary, shall propose Amendments to this Constitution, or, on the Application of the Legislatures of two thirds of the several States, shall call a Convention for proposing Amendments, which, in either Case, shall be valid to all Intents and Purposes, as Part of this Constitution, when ratified by the Legislatures of three fourths of the several States, or by Conventions in three fourths thereof, as the one or the other Mode of Ratification may be proposed by the Congress; Provided that no Amendment which may be made prior to the Year One thousand eight hundred and eight shall in any Manner affect the first and fourth Clauses in the Ninth Section of the first Article; and that no State, without its Consent, shall be deprived of its equal Suffrage in the Senate."
Tennessee has a similar procedure outlined in their Constitution (Article XI, Sect. 3). This being the case, how can the ACLU challenge the right of a sovereign state, to amend it's Constitution? Tennessee has passed a measure banning Same-Sex marriage fulfilling it's Constitutional requirements. Now the measure is set to go before the people for a popular vote. I can't for the life of me understand why the ACLU would be opposed to this. If the people want Same-Sex marriages to be lawful, then they will reject the measure and it would be up to the activist judges of the state to decide if such unions would be lawful. But if the people approve the proposed amendment to their Constitution,as prescribed in Article XI, Sect. 3, then it's truly the "will of the people". But the ACLU for some reason doesn't want the people to decide for themselves what they want. They would rather that matters such as these be settled in a courtroom in front of a few activist judges. In this way, they get paid, their agenda gets put forward, and their will gets shoved down our throats. And forever more we get to live with the decisions of a few "progressive" judges who have decided for themselves that the Congress and the people cannot make responsible law. In other words, they don't trust the American people to make the right decisions for ourselves. If you look hard at the rhetoric from the left, it's full of language that assumes that they are smarter than the rest of us. Judging by the troll traffic on our blogs, they assume that Conservatives are stupid. They assume that we are less educated then they are. That because they have progressive ideas, that makes them superior to the rest of us. That makes me remember several characters from a novel. George Orwell wrote a satire of Communism called "Animal Farm". In the novel, the pigs take over and move into the farmers house. They took on intellectually superior personalities. Do you see the similarities between the pigs in the novel and the ACLU? I do. And "Absolute Power Corrupts Absolutely". An observation that a person’s sense of morality lessens as his or her power increases. The statement was made by Lord Acton, a British historian of the late nineteenth and early twentieth centuries. It also applies to organizations. The goals of the ACLU are outlined in it's founder's own words. "I am for socialism, disarmament, and, ultimately, for abolishing the state itself... I seek the social ownership of property, the abolition of the propertied class, and the sole control of those who produce wealth. Communism is the goal." ACLU BlogBurst 4/20/05

This week's topic is the ACLU's position on the 2nd Amendment. So I guess the proper way to start is by stating their position. "The ACLU agrees with the Supreme Court's long-standing interpretation of the Second Amendment [as set forth in the 1939 case, U.S. v. Miller] that the individual's right to bear arms applies only to the preservation or efficiency of a well-regulated militia. Except for lawful police and military purposes, the possession of weapons by individuals is not constitutionally protected. Therefore, there is no constitutional impediment to the regulation of firearms." --Policy #47 What they are clinging to is the introductory sentence in the 2nd Amendment. The Amendment reads, "A well regulated militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed." The ACLU and the rest of the gun control lobby lean heavily on the introductory phrase thus creating the false assumption that it is intended to only apply to a State Regulated Militia. And they use United States v Miller as their basis. However, Miller actually states, "In the absence of any evidence tending to show that possession or use of a “shotgun having a barrel of less than eighteen inches in length” at this time has some reasonable relationship to the preservation or efficiency of a well regulated militia, we cannot say that the Second Amendment guarantees the right to keep and bear such an instrument. Certainly it is not within judicial notice that this weapon is any part of the ordinary military equipment or that its use could contribute to the common defense."(source) This decision does not address the State's rights issue or the individual rights issue. It only addresses the gun in question. "Miller grew out of a 1938 prosecution of two bootleggers (Jack Miller and Frank Layton) for violating the National Firearms Act by possessing a sawed-off shotgun without having paid the required federal tax. The federal district court dismissed the indictment on the grounds that the National Firearms Act violated the Second Amendment. Freed, Miller and Layton promptly absconded, and thus only the government’s side was heard when the case was argued before the Supreme Court."(source) "If Miller were the only source of information about the Second Amendment, the individual right vs. Government right argument might be impossible to resolve conclusively. Fortunately, the Supreme Court has addressed the Second Amendment in thirty-one other cases--although most of these cases appear to have escaped the attention of commentators on both sides of the issue. This article ends the bipartisan scholarly neglect of the Supreme Court’s writings on the Second Amendment."(source) One could actually argue that Miller never addresses the whole issue because it heard arguments only from one side. And inconclusive on it's face because it only addresses the type of weapon in relation to it's relevance to a militia, leaving the matter open and vague. Of the 31 cases discussed in the document, 24 cases support individual rights, 5 ambiguous, 1 no, and 1 no," but not necessarily inconsistent with an individual right."(source) So our friends over at the ACLU wish to hold on to one little case that was a somewhat of a victory because it was too vague to get a real meaning out of it. A case that was argued by only one side of the issue. But in typical fashion, the ACLU will over-state any victory into some ground breaking reason to challenge everything involving a similar situation. Even if it is inconclusive. The ACLU's Effort To Weaken Our Military

The American Civil Liberties Union has taken a case that would keep military recuiters from going about their business in high schools. This comes about because the son of Orlando Terrazas came home one day and told his father that he was considering a career in the military. Terrazas's position, "deciding to join the military is as important as choosing which college to attend." My position, no it isn't. As someone who has served in the military, I can tell you that it is the most important decision that you could make. Because it has the potential to cost you your life. When you consider service in the military, ask yourself just how much your country means to you. For me, my love for this country was worth my defending it with my life should it be necessary. Ask any serving on active duty or reservist and they would tell you the same. But we are missing another point. There is a large segment of the population who cannot afford college. And serving in the military offers those people an opportunity to save money in order to attend college. It offers some to even learn a marketable trade. Combat Engineers apply their trade in the private sector every day building roads, bridges, and buildings. Medics, clerks, cooks, communications specialists, mechanics, and drivers are just a few of the trades that the military can train a person to do that are just as important in the private sector. Then there are MP and SPs, divers, pilots, aircraft maintenance, aircraft payload specialists, and countless other specialties that are productive in the private sector. But there is a cost involved in these opportunities. And it may be your life. But if you are trained properly, and you remember your training in combat, the risk of death is a lot less than it was 30 years ago. That is why our military puts so much effort into training our soldiers, sailors, marines, and airmen. With training the risks are lower. Some are dying in combat right now. But they have made that choice. The age of getting a guy drunk and throwing him on a truck in the middle of the night has long past. And we haven't had a draft in 30 years. We are the only country that doesn't conscript our military. And that makes them the best. Because they want to do it, they don't have to do it. The Fascists/Nazi Comparison, What Is A Neo-Con Anyway?

There is a growing sentiment in the liberal world that conservatives are fascists and nazis. This falsehood is a deliberate misdirection from the truth. Let's take a moment to analyze the tactic. The left is putting out a message that you should fear the conservative agenda. That we are out to control the world through oppression and in some cases war. Now, who's putting forth the fear in that statement? The liberals want you to fear a world lead by conservatives. They want you to fear the prospect of peace and stability. It's the liberals who are putting out fear. They keep a grip on the elderly by putting forth rhetoric that Republicans are out to take away Social Security and Medicare Benefits. They tighten their grip on the union worker by putting forth rhetoric that Republicans are money grubbing Corporate types who don't care about their workers. They keep a grip on the African-American crowd by putting forth rhetoric that the Republicans are the party of the rich, white business owners who are out to keep the poor from advancing. And because minorities have a higher percentage of impoverished, they succeed in holding on to that grip. And now there is a new term that I don't understand. Neo-Con? Neo meaning new. And Con which I take is a contraction for Conservative. So it must mean New Conservative. So it must be a Dumocrat who finally saw the error of his/her ways. But the moonbats use the term as if it were to mean some sort of right-wing ultra conservative. But if that is true, how can they be new? I finally have come to the realization that they just don't know what neo means. First off, Republicans do not want to take away benefits from the elderly. Social Security is here to stay. But there is a financial problem. Past Congresses have against the trust fund though the years to the point that the "trust fund" is nothing more than a file cabinet drawer full of bonds. Come 2008, the Babyboomers are going to begin to collect benefits. The largest generation of Americans will put such a strain on the spend as you go system that we aren't going to be able to sustain payment. This is fact. But liberals with the help of groups like the AARP are running television ads which depict the President's plan as a complete tear down of the system. These ads lead the viewer to believe that the system that we have grown to depend upon will be changed. And as we all know, when the government changes something, it always comes out worse than it started. They system needs to be fixed. And the President put forth an idea that would help solve future benefit difficulties. He put this forward as a means of sparking debate. To kick start the process so to speak. But instead of coming forward with a proposal of their own, Congressional Dumocrats attacked the President's plan. The proposal that the President put forward isn't a fix for the system. It's a way for younger workers to grow a larger nest egg for their own retirement. Instead of insisting on hearings and committees to find a way to make the system solvent, they are on television scaring the hell out of Americans. Now think back. Remember your history? Who told his people that a segment of their population was to blame for their plight? Who scared his people into believing whatever he told them. I recall some fella named Hitler doing that. Don't you? The National Socialist Party (Nazis) used racism and fear to hold the people in line. The National Socialist Party and Italy's Fascist Party were aligned. Who is using fear now? Dumocrats. Next, Dumocrats like to put forward the idea that Republicans are pro-rich. Well in a sense they are right. But not in the way that they put it. Republicans put forth ideas that have positive impact on the economy. Building wealth is building business. Building business is creating jobs. Then more work that is available, the more workers in the work force. The more in the work force, the smaller the amount of people putting a drain on the public welfare rolls. And thus, reducing the size of the government. And keep in mind, that most working people now a days have a retirement investment plan called a 401k. That is money that is being put into the stock market to create more wealth. Wouldn't it make sense to have more people working so they could put more money into their 401k's? The Dumocratic Party likes to use the civil rights movement as their platform for holding the African-American vote. But what they don't want you to remember is, that the party that was mostly against civil rights legislation were the Dumocrats. Long time Dumocratic leader Robert Byrd (D WV) was not only a member of the KKK, he was a Grand Dragon. Southern Dumocrats were the obstructionists of civil rights legislation. Republicans are a party of inclusion. We believe that anyone can succeed if they apply themselves. Nothing in life is easy. If you work hard to better yourself, and to better you position in life, you will be rewarded for that hard work. It's called the American dream. And hard work builds wealth, which builds business, which employs people who invest to build more wealth. And as far as being war mongers. Woodrow Wilson (D NY) was President when we went to war in 1917, WWI. FDR (D NY) was President when we went to war in 1941, WWII. Harry S. Truman (D MO) was President when we went to war in Korea in 1950. John F. Kennedy (D MA) was President when we sent troops to South Vietnam as military advisors in 1962. LBJ (D TX) was President when our military advisors became combat troops as the civil war in Vietnam escalated. Gerald R. Ford (R MI) was President when our troops withdrew from Vietnam. Jimmy Carter (D GA) was President when our military was down-sized at the end of the draft putting the United States in a position of weakness. It was Jimmy Carter who was President when hostages were taken in Iran. The very day the Ronald Reagan (R CA) became President that those hostages were released. The terrorists knew that Reagan wouldn't let it go anymore. They know he would take a stand. It was Reagan who built our military into the toughest, best equipped, best trained, all volunteer fighting force on the Earth. It was George H. W. Bush (R ME) who was President when the Berlin wall came down. The Soviet Union broke up, Germany re-united, and Kuwait was liberated. William Jefferson Clinton (D AR) was President when the World Trade Center was bombed in 1993. And he did nothing. He was President when the embassies in Kenya and Tanzania were bombed and virtually nothing. He was President when the Cole was nearly sunk and retaliated with cruise missiles. He lead our troops into Somalia, a quagmire. And allowed Saddam Hussein to thumb his nose at us for 8 long years. And do you know why Saddam did that, he knew that Clinton wouldn't do anything. George W. Bush(R TX) was President on September 11, 2001 when Islamic terrorists crashed 3 airplanes into buildings and actually had a 4th that failed. And he went to Afghanistan to track down those who did it and remove the government who permitted them to operated out of their country. And now it's a new democracy. It was Bush, that sent troops into Iraq to enforce UN Resolutions which Saddam Hussein was violating. And now Iraq is a new democracy. And now democracy is spreading throughout the middle east. And it's a Republican that is at the forefront. Then there are those who believe that George W. Bush is a dictator. Well, FDR was the closest we have ever had to a dictator. He ran for President 5 time and was elected 4 times. He attempted to initiate domestic reforms that the Supreme Court ruled were Unconstitutional. He then tried to stack the court. He tried to put forth and initiative that would add a Justice for each Justice that achieved the age of 70. So he wouldn't have to ask Congress to approved of it, FDR initiated Lend/Lease to arm Britain against Hitler. No, George W. Bush is no dictator. History Of The ACLU Part 4

For the past few days, I have been posting excerpts from and paraphrasing from the Congressional Record dated September 20, 1961. This final portion will be printed here word for word. My reason, I don't wish to inadvertently misrepresent the meaning because this is important stuff. Here it goes.
Odd Coincidences

1. The ACLU, long an advocate of unlimited freedom of the press and freedom of speech, asked Secretary of Defense Charles Wilson to withdraw a pamphlet entitled "How to Spot a Communist," prepared by the 1st Army and used by the Watertown, Mass., arsenal (New York Times, June 12, 1955).

2. The ACLU protested the publishing by the League of Decency of a list of movies and books that the league considered immoral. (Reference: Daily Worker, Mar. 22, 1957). (It has long been known that one of the primary aims of the Communist Party is to subvert the morals of the American public.)

3. The ACLU, when queried by Columnist Lawrence Fertig as to why "They did not defend the most basic of all civil liberties--the right of a man to earn his living without paying tribute to any other individual or private organization" (right to work laws in various States), replied, "there are no civil liberties grounds on which such statutes should be supported," (reference: Fortnights magazine, July 1955).

4. The ACLU has voiced the opinion many times that "they welcome investigation," but they unleash their vitriolic abuse upon the American Legion and brand the American Legion as a fascist group because they not only investigated the ACLU, but have requested the HCUA every year since 1953 to investigate the ACLU.

5. The ACLU has been the recipient of numerous grants from the Garland Foundation (American Fund for Public Service) which is the notorious bankroll for Communist front organizations. The Garland Fund is characterized by the California Senate Fact Finding Commission, 1948 report, page 247, as "the source of revenue for Communist causes is generally referred to as the Garland Fund."

The Garland Fund has also been cited by the United States House Special Committee on Un-American Activities as follows: "The Garland Fund was a major source for the financing of Communist Party enterprises," (reference: H. Rept. 1311, Mar 9, 1944).

Among those who have served as directors of the Garland Fund and who were directly responsible for the disbursement of funds to the different Communist Front organizations and who were or are now prominent members of the governing body of the ACLU are: Roger Baldwin, Harry F. Ward, William Z. Foster, Robert Morss Lovett, Morris L. Ernst, Elizabeth Gurley Flynn, Oswald Garrison Villard, and E. M. Borchard.

6. Frank Wilkinson, an identified Communist and chief hatchetman for the Emergency Civil Liberties Committee and the Citizens Committee to Preserve American Freedoms in the "Operation Abolition" program, who, so far as we know, is not even a member of the ACLU, seems to be so prominent in the affairs of the ACLU. Also, an odd coincidence that a new organization that has been formed and which calls itself the National Committee to Abolish the House Un-American Activities Committee (NCAHUAC) and has eight key members in the organization that have been identified as members of the Communist Party gives its mailing address at 617 North Larchmont Boulevard, Los Angeles 4, Calif., which is also the mailing address of the Citizens Committee to Preserve American Freedoms (CCPAF) and that of the 12 national committee members of the NCAHUAC, eight are currently officers or executive committee members of the Emergency Civil Liberties Committee (interlocking directorates?).

If any ACLU spokesman charges that this report is biased, our answer is that is is biased only on the side of Americanism--that its only fault for those who don't like it is its bias in favor of truth and fact. in our months of investigation we were unable to find one occasion where the ACLU has something good to say about America. We were able, however, to find many occasions where the ACLU and its leaders had something good to say about Soviet Russia or did something that would benefit Soviet Russia.

In our opinion, the ACLU and its brother organizations have mastered the technique of Josef Goebbels and practiced by the Moscow Communists to the nth degree. "Tell a lie, make it big, and tell it often enough so that soon everyone will believe it." They have been spouting forth the statement that "the rights of all Americans are being threatened" so long and so hard that already everyone is looking for the Gestapo FBI, the Fascist police, the minions of that inquisition, the HCUA, behind every bush and every telephone.

Deep down in the hearts of all good Americans we know that this is a lie and if we stop and think of its source, then we can look at it in its true light.

Nicolai Lenin said, "We must build communism with non-Communist hands," Please don't let it be your hands.

A Soviet dialectician's definition of a Communist front

George Dimitrov, "Advice to the Lenin School of Political Warfare," as quoted in the report of the American Bar Association Committee on Communist Tactics, Strategy and Objectives--CONGRESSIONAL RECORD, August 22, 1958, page 17719. "As Soviet power grows, there will be greater aversion to Communist Parties everywhere. So we must practice the techniques of withdrawal. Never appear in the foreground; Let our friends do the work. We must always remember that one sympathizer is generally worth more than a dozen militant Communists. A university professor, who, without being a party member, lends himself to the interests of the Soviet Union, is worth more than a hundred men with party cards. A writer of reputation or a retired general are worth more than 500 poor devils who don't know any better than to get themselves beaten up by the police. Every man has his value, his merit.

Summation
The ACLU is a dangerous anti-American organization. It has long touted it's non-partisan position and claims that it has no agenda but the protection of the Bill of Rights. Well in my next post, I will be addressing their assault on the Bill of Rights, specifically the 1st and 10th Amendments. What I am surprised at is, not only does most Americans who know what the ACLU is, believe that it's an instrument for good in this country, but there are so many Americans who don't even know what the ACLU is. With their cohorts in Hollywood touting their rhetoric in movies and on television, I am totally shocked at the notion that many people don't even know that this very organization is destroying their rights. And they do it while getting the hails and accolades from those who influence the masses. Bottom line, the ACLU and their Communist conspirators target the uninformed. They want you in the dark. They don't want you to think. They want you to just believe what they say and be happy that they are doing your will. But I'll tell you, they are not doing my will. And if you have the capacity to think for yourself, take an objective look at the organization. Do the research with an open mind. And if you do, you will be joining our fight.
